Well, it's actually due to a law from a long ass time ago (I'm talking close to one hundred years) due to having 'non nutritive objects' in them. That and while cigarettes are bad the U.S makes a fuck ton of money off taxing them. I imagine if they could tax kinder eggs to the point it results in billions they would.
